4. EVENT ACCESS & BOAT EXPERIENCE DISCLAIMER
The Catamaran Sunset Experience (Experiencia²) is offered as part of the digital experience framework of We.Be.Capital E.E. (We.Be.2 Experience / Webe2Experience).
This activity is designed as a content-based experiential event, combining music, networking, and lifestyle moments for participants of the wider We.Be.2 Experience community.
Nature of Service
Participation in the boat event does not constitute a charter, transport, or travel service. We.Be.Capital E.E. acts solely as an experience curator and content production facilitator. All vessel operations are managed by licensed third-party charter companies with valid maritime certification and safety compliance.
The guest’s payment secures participation in a pre-arranged digital experience that includes access to an already chartered vessel and curated onboard programming (music, photo & video content, and community interaction). No independent vessel rental or nautical service is being sold or subleased.
Media & Content Component
This experience is designed as a creative and social engagement event where guests may be included in visual material captured during the experience environment. Participation includes the possibility of being featured within the broader We.Be.2 experiential ecosystem, which may involve visibility within community-facing digital moments, group presence, or creative outputs produced during the event.
The Company does not guarantee specific promotional outcomes, exposure levels, or individual placement. Any inclusion of participants in creative or social elements is at the discretion of the Company and forms part of the experiential nature of the event. Guests consent to the creation and use of such materials as described in the Media Rights section of this Disclaimer.
Liability & Safety
While all operations follow maritime safety regulations, guests participate voluntarily and at their own risk. The Company is not responsible for accidents, injuries, or property loss that occur onboard or in transit to the departure location. All participants must follow crew and safety instructions at all times.
Legal Framing & Enforcement Protection
Supplementary Legal Clarifications (VATHOS Review Enhancements)
Participation does not involve the sale or provision of transportation from one location to another. The Company does not allocate, manage, or sell passenger capacity on any vessel. Because this is a personalized experiential digital service, EU consumer withdrawal rights do not apply.
Participants must not be under the influence of drugs or excessive alcohol that could impair judgment or physical safety.
No part of the participant’s payment corresponds to vessel charter fees. The vessel departs and operates regardless of participant attendance; the Company’s service is not tied to maritime transport.
This service does not constitute the sale of an event ticket. Marine instability and motion are inherent natural conditions and not the responsibility of the Company.
We.Be.Capital E.E. facilitates participation in a third-party event environment and does not control, manage, or operate any part of the maritime activity.
Non‑Chartering & No Maritime Service Clause
We.Be.Capital E.E. does not provide, sell, broker, sublease, or operate maritime transport or vessel chartering services. The Company does not receive payment for transportation, navigation, or vessel use. All maritime activity associated with the experience is conducted exclusively by a licensed third‑party charter company, which retains full operational, legal, and commercial responsibility for the vessel, crew, safety procedures, compliance, and passenger management.
The participant’s payment to We.Be.Capital E.E. covers only the curated digital experience, coordination, media production, and access to a pre‑arranged lifestyle event — not transportation, navigation, or charter services of any kind.
Participation in the event does not constitute a commercial charter contract between the participant and We.Be.Capital E.E.
This experience is categorized and invoiced as a digital experience service under EU and Greek law (Directive (EU) 2015/2302, Ν.393/1976). We.Be.Capital E.E. does not perform any maritime, travel, or passenger transport operations. All vessel navigation, safety, crew management and maritime compliance are carried out exclusively by licensed third‑party charter operators.
By participating, guests explicitly acknowledge that We.Be.Capital E.E. is not the carrier, operator, transporter, or charter provider, and therefore cannot be held liable for any operational, mechanical, environmental, or navigational matters pertaining to the vessel or its crew.
Participants further agree that all maritime‑related liabilities fall under the responsibility and insurance coverage of the third‑party charter company operating the vessel. The Company’s role is limited strictly to experience coordination and digital content creation, not transportation or chartering.
Accident & Bodily Injury Waiver
Guests acknowledge that participation in a boat‑based event inherently involves physical and environmental risks, including but not limited to vessel motion, waves, sudden movements, slippery or wet surfaces, uneven flooring, stairs, railings, crowded spaces, interactions with other participants, and weather‑related conditions.
By attending, guests voluntarily assume all risks of injury, accident, or harm that may occur onboard, during boarding or disembarkation, inside the marina, on the dock, or in connection with any maritime activity.
Guests expressly waive any claim against We.Be.Capital E.E., its partners, affiliates, or representatives for:
- bodily injury or physical harm,
- medical expenses,
- temporary or permanent disability,
- emotional distress or psychological impact,
- property damage or loss,
- harm caused by third parties or other guests,
- injuries resulting from sea conditions, vessel movement, or environmental factors.
All maritime safety and accident liability is exclusively covered by the licensed charter operator’s insurance, in accordance with maritime law. We.Be.Capital E.E. bears no responsibility and holds no duty of care regarding the vessel’s operation, mechanical status, navigation, crew conduct, or onboard safety measures.
Participants agree that they are solely responsible for their personal safety and must follow all instructions issued by the vessel crew. Failure to do so constitutes voluntary assumption of risk.
Refund Policy & Financial Liability
All payments for the Catamaran Sunset Experience (Experiencia²) are final and non‑refundable, regardless of weather conditions, scheduling changes, personal circumstances, or inability to attend. This policy ensures fairness and supports the pre‑arranged nature of the digital experience and chartered event access.
By completing payment, the participant waives any right to request refunds, chargebacks, disputes, or financial claims against We.Be.Capital E.E., its partners, or affiliated entities. No financial compensation, reimbursement, or partial refunds will be issued under any circumstances.
Participants also acknowledge that no legal claims, financial recovery actions, class actions, civil disputes, punitive damages, or liability‑based allegations may be brought against the Company arising from cancellation, non‑attendance, weather conditions, vessel operator decisions, itinerary changes, third‑party actions, or dissatisfaction with any part of the experience.
By completing payment, the participant agrees that any dispute must be resolved privately, directly with the Company, and may not proceed to public claims, bank disputes, chargebacks, or litigation. Any attempt to initiate a chargeback or legal claim constitutes a breach of this Agreement.
Summary:
This is a curated, content-driven experience that grants access to a pre-chartered catamaran event under third-party operation, organized for digital content, community, and lifestyle participation — not a transport or chartering service.
5. Nature of Services – Advisory Only
We.Be.Capital L.P. (operating as We.Be.2 Experience, website (www.webe2experience.com) and Instagram profile (@webe2_experience)) (from now on mentioned as ''We.Be2''), does not act as a tour operator or travel agency, and does not sell or issue travel products such as airline tickets or transportation services.
However, We.Be.2 Experience may, for convenience and as part of its digital experience package, transfer pre-purchased festival tickets or facilitate accommodation coordination through third-party booking platforms on behalf of the client. These actions are carried out as courtesy inclusions within the advisory service and not as independent sales of travel arrangements.
We act strictly as an experience consulting and digital content entity, providing:
- Educational and lifestyle-based travel advice
- Recommendations and sample itineraries
- Personalized digital e-books and guides
- Optional group chat support for non-binding suggestions
All deliverables remain within the scope of digital informational services, in full alignment with Directive (EU) 2015/2302 and Greek Law N.393/1976, ensuring We.Be.2 is not misclassified as a tour operator
6. Communication & Service Channels
All client communication occurs through:
- Encrypted WhatsApp conversations
- Official We.Be.2 emails
- Access to online group chats for coordination, Q&A, and travel support
These communications are non-binding suggestions and lifestyle content, not contractual travel obligations.
7. Waiver of Liability & Risk Disclaimer
By using our services, all clients acknowledge:
- We.Be.2 is not liable for any personal injury, loss, theft, cancellation, or dissatisfaction arising from their travel or experience.
- All clients participate at their own risk, having fully understood the informational-only nature of our material.
- We.Be.2 does not assume responsibility for external services suggested (hotels, rentals, venues, events), nor does it act as intermediary.
- Our content does not constitute legal, medical, or professional advice.
- Clients are solely responsible for verifying visa requirements, vaccinations, insurance, and travel eligibility.
This disclaimer complies with Regulation (EU) 2016/679 (GDPR) and Directive 2011/83/EU on consumer rights.
8. Payment Policy & Cancellations
- Payments are non-refundable, except in cases of technical duplication.
- Flexibility is allowed for transfer of attendance, provided that:
- Clients notify the We.Be.2 team at least 7 days prior to departure
- All changes are approved in writing via WhatsApp or email
9. Legal Scenarios & Protection
We.Be.2 preemptively waives liability for:
- Accidents or injuries occurring during recommended events or trips
- Misunderstandings caused by interpretation of content
- Tax-related matters and declarations by the user
Any disputes regarding income, service characterization, or indirect sales are to be assessed under the definition of digital lifestyle guidance—not commercial travel sales.

10. Nature and delivery of services
The services provided by We.Be2 are strictly consultative, lifestyle-oriented, and informational in nature. We.Be.Capital L.P. does not function as a travel agency or tour operator. All services are delivered in the form of digital guidance, curated suggestions, and personalized planning through our official website (www.webe2experience.com) and Instagram profile (@webe2_experience). Client interaction occurs exclusively via Instagram and WhatsApp, while final sales are completed verbally when clients are directed to complete payment through our official payment link.
Upon purchase, the client receives:
- Immediate delivery of any festival tickets or passes previously purchased by WeBe2 for confirmed participants
- A "Personal Travel Guide" tailored to the user’s timeline, preferences, and booking intentions, delivered up to one week prior to arrival
- Optional accommodation coordination, managed as a courtesy service through third-party booking platforms
All materials are delivered digitally through our online e-book system and communication tools (WhatsApp, Instagram, email). This ensures that the primary service provided is digital content and personalized advisory material rather than direct travel sale.
11. Payment Method and Secure Transactions
All payments for services rendered by We.Be.2 are processed securely via Revolut, under the registered entity name We.Be.Capital E.E., or alternatively via PayPal, ensuring flexibility and security for clients.
- Upon confirmation of services, each client receives a private confirmation message via WhatsApp or Instagram containing their payment link and agreement details. Payments are confirmed directly through messaging and do not generate automatic invoices or emails.
All transactions are encrypted and comply with PCI DSS standards (Payment Card Industry Data Security Standard) to ensure maximum security.
We.Be.2 and its partners do not store any cardholder information. Payment processing is conducted exclusively through Stripe’s certified infrastructure.
Users agree that digital delivery of invoice and payment confirmation is sufficient and legally binding for the purposes of acknowledging receipt of services and acceptance of all terms and disclaimers herein.
12. Media release, Content Release, Testimonial Consent
By participating in any experience or event involving We.Be.2, the user grants irrevocable permission for their image (photo/video) to be captured and used for:
- Social media promotion
- Website placement
- Reels, highlight videos, and campaign content
Clients may request content removal post-publication; however, no financial compensation is applicable.
We.Be.Capital L.P. and its affiliates hold perpetual, worldwide, royalty-free rights to record, reproduce, edit, share, license, or otherwise use any form of content created during your participation. This includes, but is not limited to:
- Photos or video footage captured during the experience
- Voice and audio recordings
- Voluntary testimonials, feedback, or written/recorded messages shared during or after the event
Such content may appear in future promotional, educational, or editorial materials, across digital, print, or broadcast formats, including but not limited to social media, the official website, and partner platforms.
You understand and agree that you will not receive any financial compensation or have any right of approval for how this material is used. You hereby release We.Be.Capital L.P. from any claims related to the use, distribution, or adaptation of such media.
This consent is irrevocable, transferable, and valid indefinitely.
13. MEDICAL DECLARATION & WAIVER OF LIABILITY
You acknowledge and voluntarily assume all risks associated with participation in We.Be.2 Retreats or Experiences, which may include physical, emotional, mental, or environmental exposure through activities such as:
- Yoga, breathwork, meditation, sound healing, movement practices, nature-based excursions, and immersive experiences
You represent that:
- You are in good physical and mental health
- You have consulted a medical professional as needed before attending
- You will carry required medications and inform the Company of any serious condition
Release of Liability:
To the maximum extent permitted by law, you expressly and irrevocably waive and release the Company, its directors, employees, agents, facilitators, subcontractors, and affiliates from all liability for:
- Any loss, damage, illness, delay, emotional trauma, accident, injury, or death
- Any claims arising from your participation or use of services or facilities, whether in contract, tort (including negligence), strict liability, or otherwise
This includes but is not limited to risks arising from:
- Travel delays, weather conditions, natural disasters
- Political unrest, public health crises, or global pandemics
- Your own conduct or actions of third parties
14. INSURANCE
You are required to maintain suitable travel and health insurance that includes coverage for:
- Trip interruption or cancellation
- Medical treatment or hospitalization
- Accidents, liability, and emergency evacuation
- Loss, theft, or damage of personal property
We.Be.Capital L.P. bears no responsibility for personal medical costs, travel disruptions, or lost belongings, and does not provide personal insurance to participants.
15. FINAL ACKNOWLEDGMENT
By enrolling or registering for any We.Be.2 Experience, you confirm that:
- You have carefully read, understood, and accepted this Agreement and all related disclaimers
- You choose to participate voluntarily and acknowledge all inherent risks
- You grant full consent for the use of media content as described above
- You release the Company from all liability claims, including in the case of accident, injury, or death
By proceeding with payment, you acknowledge that your participation constitutes binding acceptance of these terms.
